General Terms and Conditions of Sale (GTC)

1. Scope of Application: These GTC apply to all transactions conducted through our online store based in Switzerland, with our customers, regardless of their geographic location. They exclusively govern the relationship between Elastics group SNC (IDE : CHE-384.366.721) (hereinafter referred to as "the Seller" or "we") and the Customer (hereinafter referred to as "the Customer" or "you").

2. Acceptance of Conditions: Customer GTC that deviate from ours are not applicable unless expressly acknowledged in writing by the Seller. A process is in place to review and, if applicable, accept these alternative conditions.

3. Limitation of Liability: The Seller is fully liable for any intentional or grossly negligent breaches of duty. For minor breaches of duty, liability is limited to direct and foreseeable damages at the time of contract conclusion, except in cases of injury to life, body, or health. This limitation does not apply to mandatory liabilities, such as those defined by the Product Liability Act.

4. Applicable Law and Jurisdiction: Swiss law applies, excluding conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from these GTC will be Geneva. For consumers, the place of jurisdiction is also the customer's place of residence.

5. Validity of the GTC: Should any provision of these GTC become invalid, this does not affect the validity of the remaining provisions. This is a general precautionary measure.

6. Changes to the GTC: Any modifications or updates to our GTC will be directly published on our website. It is the customer's responsibility to regularly review the GTC to stay informed of any changes.
